It is a known issue, yes.

The Intelligent Access isn't active 24/7. It's more of an on-demand system.
When you touch a door handle, that specific handle broadcasts a low-frequency signal to your keyfob. The keyfob then broadcasts its code back to the TPM.
When you press [ENGINE START], the low-frequency signal comes from an antenna in the center console.

In either case, the antennae only have an effective range of about 1 meter / 3 feet.

Keeping the keyfob in your left pocket, especially with a phone, often makes it undetectable.
With the door handle, you're probably touching the handle with your right hand, so your left pocket is a bit further away.
Sitting in the driver's seat, your left pocket is definitely further away from the center console than your right.

I think on newer models, they have all the antennae broadcast simultaneously when attempting to start the engine, but I may be wrong.
